1. Acceptance of Terms
By accessing or using the services provided by NervaShift (“we,” “our,” or “us”), including our website (nervashift.com), coaching sessions, breathwork classes, workshops, and any other related services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Services.
2. Description of Services
NervaShift provides science-backed, trauma-informed breathwork and coaching services. Our offerings include, but are not limited to:
1:1 Coaching
Group Resilience Sessions
Recovery-Supportive Breathwork
Corporate Stress & EI Workshops
Live Intensives and Retreats
3. User Eligibility
You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you have the right, authority, and capacity to enter into these Terms and to abide by all of the terms and conditions set forth herein.
4. User Accounts
4.1. To access certain features of our Services, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
4.2. You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password. We encourage you to use “strong” passwords (passwords that use a combination of upper and lower case letters, numbers, and symbols) with your account.
5. Payment and Refunds
5.1. Fees for our Services are clearly displayed at the point of purchase. By purchasing our Services, you agree to pay the specified fees.
5.2. All payments are non-refundable except in cases where we are unable to deliver the promised Services. Refund requests will be handled on a case-by-case basis and at our sole discretion.
6. Cancellation Policy
6.1. For 1:1 coaching sessions and group classes, cancellations must be made at least 24 hours in advance to receive a full refund or reschedule without penalty.
6.2. For workshops and retreats, our cancellation policy will be specified at the time of booking.
7. Intellectual Property Rights
7.1. The content, organization, graphics, design, compilation, magnetic translation, digital conversion, and other matters related to the Services are protected under applicable copyrights, trademarks, and other proprietary rights.
7.2. The copying, redistribution, use, or publication by you of any such matters or any part of the Services, except as allowed by Section 8, is strictly prohibited.
8. Limited License
We grant you a non-exclusive, non-transferable, limited right to access and use the Services for your personal, non-commercial use, subject to these Terms.
9. User Conduct
You agree not to use the Services for any unlawful purpose or in any way that interrupts, damages, or impairs the Services. This includes but is not limited to:
Transmitting any harmful or disabling computer code
Impersonating any person or entity
Stalking, harassing, or harm to any individual or group
Violating any applicable laws or regulations
10. Disclaimer of Warranties
10.1. The Services are provided on an “as is” and “as available” basis. We expressly disclaim all warranties of any kind, whether express or implied.
10.2. While our Services are designed to support your well-being, they are not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.
11. Limitation of Liability
To the fullest extent permitted by applicable law, NervaShift shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
12. Indemnification
You agree to indemnify and hold NervaShift harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the Services.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the new Terms on our website. Your continued use of the Services after such modifications will constitute your acknowledgment and agreement to the modified Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
